Bail refused in Hughes murder case

TWO men accused of the murder of Dungannon father-of-three Eamonn Hughes have been refused bail at East Tyrone Magistrates Court.
23-year-old William McDonagh from Kew Gardens in Ballymena and Kevin Michael Charles Toye (22) from Windmill Drive in Dungannon are both charged with the murder of Mr Hughes and the hijacking of a taxi. Toye also stands accused of two counts of grievous bodily harm against two women injured in the incident which took place in the entrance of the Lisnahull estate on September 13.
A packed court heard Toye's solicitor make a bail application for his client who appeared by video link in the Dungannon courtroom.
Outlining the case against the accused, an officer from the PSNI told the court there were a number of objections to bail including his belief that the defendant would re-offend and interfere with witnesses as he was from the Dungannon area.
The solicitor for the defence countered that there was an address available for him outside the county and that stringent bail conditions could be arranged with a surety of £15,000 in place.
The PSNI officer also told the court that there were a number of objections to the bail application of William McDonagh. He said that he believed that McDonagh would re-offend, citing that he was under investigation for possession of an offensive weapon and GBH in the Ballymena area. The officer also said that he believed that the defendant would interfere with witnesses and would not keep to any bail conditions set by the court.
McDonagh's solicitor submitted that as his client had already been granted bail for other charges in Ballymena area and his 'strongly workable defence' made him a suitable applicant for bail.
District Judge Peter Murphy denied bail for both men before adjourning their cases and remanding them to custody until November 5.
The cases of Liam Patrick Kevin Murray (21) from Windmill Court in Dungannon and Martin Raymond Jude Murray (21) from Windmill Drive in Dungannon were also adjourned with both men remanded to custody until November 5. Both men are charged with the murder of Mr Hughes and the hijacking of a taxi.
A fifth man, Kevin Murray (39) of Lisnahull Gardens in Dungannon, also appeared by video link charged with the attempted murder of Kevin Hughes on September 13. The case was adjourned and Murray was remanded to custody until November 5.
