Drunk in charge after night out
TEN penalty points have been imposed in the case of a Dungannon man who was found to be in charge of a vehicle while unfit.
Danius Pocius, 24, from Coolhill Mews in the town, pleaded guilty to the offence, which came to light following a night out with friends on January 29.
Dungannon Magistrates Court was told police came upon a parked car in the Church Street area at around 1.40am.
The vehicle was open and a number of males were seen standing around, listening to music which was being played at an “unsociable level”, a prosecutor explained.
The keys were in the ignition of the vehicle and the engine was running, the court heard.
A sample of breath provided by Pocius showed an alcohol level of 82mg, 47mg in excess of the legal limit.
Defending, Pocius’ solicitor explained his client had been to a bar with friends, and had gone to the car to get his glasses.
When police arrived on the scene, the solicitor added, Pocius had been demonstrating the car’s CD player to his friends, but did not have any intention to drive.
A fine of £100 was also imposed in the case.
