A man caught drink driving in Clogher was on his way home after leaving a hotel because of excessive noise in the early hours.
East Tyrone Magistrates Court heard how police were on Main Steet around 4.30am on May 29.
They were following a van which was not maintaining its line on the road and was not travelling at a steady speed.
After pulling the vehicle over, the driver, Thomas Wallace, 48, from Paisley’s Road in Carrickfergus, later provided a sample a time and a half over the limit.
“This is his first time before a court,” said Mr Blaine Nugent, defending.
“He had a meal and a number of drinks at the hotel but was woken early hours because of excessive noise.
“He made the foolish decision to drive home as he couldn’t sleep.”
District Judge John Meehan handed down a fine of £120 and a 12 month driving disqualification.
He also registered him for the drink driving course.
